800 plus and working in the UK: eligibility and Child Benefit (2026)

According to gov.pl, Polish 800 plus goes to Polish citizens who live in Poland; ZUS assesses a family in the UK. The rules differ for people covered by the Withdrawal Agreement and for those who came to the UK from 2021. As of November 2026.

In short

  • 800 plus and working in the UK: 800 plus (the Polish child-raising benefit, świadczenie wychowawcze: PLN 800 a month per child up to age 18, as of November 2026, ZUS) goes, according to gov.pl, to Polish citizens who live in Poland. The collected sources do not settle the position of a whole family living in the UK; discuss it with ZUS (the Polish Social Insurance Institution).
  • Two groups (as of November 2026, gov.pl). People covered by the Withdrawal Agreement retain coordination to the extent described below. For people who came to the UK from 1 January 2021, the Trade and Cooperation Agreement does not cover family benefits; how ZUS handles their claim, the sources do not say.
  • In cases covered by coordination, the application requires information about work, residence or benefits abroad, yours and the other parent's (ask ZUS how to give it for the UK; gov.pl). Report changes to ZUS within 7 days (gov.pl).
  • UK Child Benefit: according to ZUS, the exception for a similar benefit abroad does not apply to benefits from the United Kingdom. How HMRC takes 800 plus into account, the sources do not say.

Who gets 800 plus and do you have to live in Poland

800 plus is PLN 800 a month per child (as of November 2026, ZUS). It is paid for every child up to the age of 18, regardless of income, to a mother, father or de facto guardian if the child lives with them and is supported by them. The benefit is exempt from enforcement and is not taxed (gov.pl).

The residence condition. The gov.pl service page (gov.pl, updated 1 October 2026) lists Polish citizens who live in Poland. The collected sources do not settle the position of a whole family living in the UK; discuss such a case with ZUS before you apply (contact details at the end).

What is coordination and when does it concern the UK

800 plus is covered by EU social security coordination as a classic family benefit. The Polish Ministry of Family, Labour and Social Policy (MRPiPS) says the coordination rules apply when the applicant or the child's other parent lives or works, or receives a benefit (for example a pension or unemployment benefit), in another EU or EEA state, in Switzerland “or in some cases” the United Kingdom (as of November 2026, gov.pl). The page does not explain which cases.

Within the EU, the state that pays first is set in this order: work or self-employment, then a pension, then place of residence. One country pays in full and the other pays the difference (a differential supplement) if its benefits are higher (gov.pl). That page describes the EU and does not mention the UK. Since 1 June 2022, Poland has paid 800 plus in full, once the conditions are met, regardless of which state has priority under EU rules (gov.pl).

Voivodeship offices (urzędy wojewódzkie, regional government offices) decide whether and for what period coordination applies; ZUS passes them the application after granting the benefit. You must also tell the foreign institution about changes and about the benefit granted in Poland. The final decision on a foreign benefit rests with the institution that awards it.

The Withdrawal Agreement: who retains coordination rights

The post-Brexit transition period ended on 31 December 2020, and the Withdrawal Agreement remains in force (as of November 2026, gov.pl). That page dates from before 2022 (it uses the old name “500+” and old authorities), so we take only dates and the scope of people from it. According to it, coordination still covers family and child-raising benefits where a family member began living in the UK before the transition period ended, at the end of 31 December 2020, and still lives there, while the rest of the family lives in Poland.

The UK government guide (GOV.UK) says the Withdrawal Agreement creates a group to whom the EU coordination rules continue to apply. In full scope are primarily people who were in a cross-border UK–EU situation on 31 December 2020 and remain in it, for example EU citizens with a right to reside in the UK. Family members include the children of the right holder, also those born or adopted after 31 December 2020. Statuses are covered in our guide to the EU Settlement Scheme.

This status is not fixed. A change of circumstances can change your coverage under the Withdrawal Agreement's coordination provisions. Before leaving or returning, ask ZUS and HMRC about the implications for your case.

MRPiPS example (the authority named is out of date: since 2022, ZUS handles 800 plus). A husband returned from the UK to Poland on 10 January 2021 and did not claim UK unemployment benefit, and from 27 February 2021 he worked in the UK again. Coordination does not apply to the new application because the period under the Withdrawal Agreement was interrupted, so the case is decided under national rules only.

Coming to the UK from 1 January 2021: what the sources say

The Trade and Cooperation Agreement (TCA) with its protocol on social security coordination entered into force on 1 May 2021 (as of November 2026, gov.pl). According to MRPiPS, it applies to cross-border events from 1 January 2021, not to people protected by the Withdrawal Agreement. The list of benefits coordinated under the TCA (including sickness, maternity, pensions, unemployment) does not include family benefits or the child-raising benefit.

In its comparison table, the UK government guide from 2021 (GOV.UK) marks Child Benefit, Child Tax Credit and Guardian's Allowance as “Benefits excluded” in the TCA column. It adds that they are no longer exportable to the EU, except for people in scope of the Withdrawal Agreement and UK and Irish nationals in Ireland.

At the same time, MRPiPS says coordination applies to the UK “in some cases”. How ZUS will handle an 800 plus application from a family in which someone has worked in the UK since 2021 (with coordination or under national rules only), the sources do not say. Do not conclude from the above that 800 plus is or is not payable. Ask ZUS.

Child Benefit and 800 plus: can you have both

ZUS's position. According to ZUS (as of November 2026, ZUS), the benefit is not payable if you or a family member are entitled abroad to a similar benefit for the child, but this exception does not apply to benefits from EU/EFTA states or from the United Kingdom. Gov.pl puts it more generally: “unless the coordination rules provide otherwise” (gov.pl). These are the positions of ZUS and gov.pl; the sources do not say whether they apply to each of the two groups, or how HMRC takes 800 plus into account for Child Benefit.

Child Benefit when your child lives in Poland. Conditions, rates and how to claim are in our guide to Child Benefit and Universal Credit. Here we cover only a child living in Poland. If you move to the UK, you must show that the UK is your main home, and in most cases your child must live with you. When the child lives in an EU or EEA country or in Switzerland, you may get Child Benefit if you have settled or pre-settled status or are covered by another condition in the agreements with the EU (GOV.UK). In addition, you or your partner must pay UK National Insurance or get one of the listed benefits (including New Style JSA, contribution-based ESA, State Pension, SMP).

Tell the Child Benefit Office if you go abroad for more than 8 weeks (GOV.UK).

How to apply for 800 plus when someone in the family works in the UK

  1. If you are the child's mother or father, submit form SW-R electronically only: through eZUS (ZUS's online portal), the Emp@tia portal, internet banking or the mZUS app (ZUS, as of November 2026). Emp@tia, mZUS and the bank route are for parents with a PESEL number (the Polish national identification number); for a child born in the UK, see our guide to the birth certificate, PESEL and passport.
  2. State any residence or work in the UK. In cases covered by coordination, MRPiPS requires information about the applicant's or the other parent's residence, work or benefits abroad (gov.pl). As it refers to “some cases” for the UK, ask ZUS how to complete the application in your circumstances. ZUS has separate instructions for form SW-R “with coordination” and without it.
  3. Give a bank account. ZUS pays into an account in Poland; someone living in an EU/EFTA state may receive the benefit into an account in that state. On an account in the UK, ZUS's pages say nothing.
  4. Watch the deadlines. The benefit period runs from 1 June to 31 May. Applications for 1 June 2026 to 31 May 2027 could be submitted from 1 February 2026 (ZUS). To receive the benefit already in June, you must apply by 30 April.
  5. Report changes on your profile within 7 days; failing to do so may mean you have to repay unduly received benefits (gov.pl).

ZUS deadlines for the 2026/2027 period (application correctly completed, with documents, ZUS):

Check the dates for later periods on the ZUS website. On 20 October 2026 the Council of Ministers adopted a draft law on automatic renewal of 800 plus from the 2027/2028 period (from 1 June 2027). This is not yet law. Under the draft, a new application will still be needed after, among other things, a family returns from abroad to Poland (gov.pl).

Scotland, Wales and Northern Ireland

ZUS decides entitlement to 800 plus, and for Child Benefit you deal with HMRC. The sources give no differences between England, Scotland, Wales and Northern Ireland on this topic.

Frequently asked questions

Will I get 800 plus if I work in the UK and my child lives with me in the UK?

The sources do not settle this. According to gov.pl, 800 plus goes to Polish citizens who live in Poland (as of November 2026, gov.pl); discuss such a case with ZUS.

What if I am moving back to Poland?

For people covered by the Withdrawal Agreement, MRPiPS counts returning to Poland after ending employment in the UK as a significant change that must be reported (as of November 2026, gov.pl). We cover other matters in our guide to moving back to Poland from the UK.

What happens if I do not state my work in the UK on the application?

In cases covered by coordination, omitting this information may result in the benefit being treated as unduly received (gov.pl, as of November 2026). Before submitting the application, ask ZUS how to report your circumstances.

Do I have to use a paid intermediary?

No. MRPiPS says the benefits can be obtained independently and free of charge, directly from the offices (gov.pl, as of November 2026).
